Erie Board of Trustees Action Items - June 27, 2017

Board Approves Partners in Energy MOU with Xcel

During last night’s meeting, the Board approved a resolution authorizing a Memorandum of Understanding with Xcel Energy outlining responsibilities related to the Partners in Energy Program (PiE). This two-year program consists of a six-month planning phase and an eighteen-month Implementation phase and is meant to assist communities to identify and prioritize their energy needs. Partners in Energy aims to:

  • Develop and document our community’s long-term energy vision
  • Identify the appropriate goals and strategies to help achieve that vision
  • Engage and motivate our community to take action to achieve your goals
  • Monitor and track results
  • Celebrate achievements and promote successes
  • Carry forward the Town’s energy momentum for the long term

PiE presents an opportunity for the Town to identify cost savings, support economic development and save energy. The two-year Partners in Energy process consists of:

  1. Working with community representatives for an initial 6 months to develop a vision, goals and action plan for the community.
  2. An 18-month implementation stage to engage the community and work together the community’s energy goals.

Board Signs on to Boulder County Amicus Curiae Brief

The Board approved a resolution authorizing the Town Attorney to sign on behalf of the Town a Motion for Leave to file an Amicus Curiae Brief In opposition to the Petition For Writ of Certiorari and an Amicus Curiae Brief in support of the respondents/appellants and among a grant of Certiorari in Colorado Oil And Gas Conservation Commission V. Martinez.

BACKGROUND: Boulder County has asked if the Town of Erie would have an interest in signing on to their Amicus Curiae Brief. They are trying to get interested cities and counties to join in submitting the amicus brief urging the Colorado Supreme Court not to grant certiorari and review the Martinez v. Colorado Oil & Gas Conservation Commission (COGCC) opinion.

The Court of Appeals ruled in Martinez that the COGCC must make all of its oil and gas development decisions, including in rule-makings, subject to the “protection of public health, safety, and welfare, including protection of the environment and wildlife resources.”
